Rock Band Nirvana Sued for Sexual Exploitation

Popular rock band Nirvana took over the charts following their breakout in 1987. The band, mostly known for singles such as “Smells Like Teen Spirit,” “Come As You Are,” and “Where Did you Sleep Last Night,” is being sued for sexual exploitation from their 1991 Nevermind album cover. The front of the iconic album features a naked newborn baby underwater, who is now a grown man and aiming at the rockband for “[failing] to protect and prevent him from being sexually exploited.”

30-year-old Spencer Elden says that the rock band said they would cover his genitals in the album cover and did not stick to that promise. Nirvana’s “Nevermind” album would sell at least 30 million copies worldwide and a break-in at the number 1 spot on Billboard’s Hot 200.

According to court documents, “Defendants knowingly produced, possessed, and advertised commercial child pornography depicting Spencer, and they knowingly received value in exchange for doing so.”

Elden’s attorney claims he suffered “permanent harm” due to his association with the album and a “lifelong loss of income-earning capacity.”  

“He hasn’t met anyone who hasn’t seen his genitalia,” said his attorney, Maggie Mabie. “It’s a constant reminder that he has no privacy. His privacy is worthless to the world.”

Elden refers to the image as child pornography and asks for the group and Kurt Cobain’s estate to pay at least $150K each.

Premiered earlier today on Apple Music via Zane Lowe’s World Record on Beats 1, the “Old Town Road” follow-up switches things up from the urban country sound Lil Nas X has been coasting at the top of the Billboard Hot 100 with to a more on-trend emo trap vibe. “Panini” actually interpolates a sample of “In Bloom” by Nirvana, which doubles down on the alternative mood of the song and even gives Kurt Cobain some postmortem writing creds as well. For those that feel like X is abandoning his country steez, it actually looks like he’ll be experimenting with a range of sounds heard on Top 40 radio based off the rock-tinged Travis Barker collab “F9mily (You & Me)” previewed in his IG post above. The new single is produced by Take A Daytrip, and sees the viral multi-genre sensation referencing the classic Cartoon Network series Chowder and the possessive relationship that “pink cabbit” Panini has over the titular character.

Marc Jacob Denies Stealing Nirvana’s Smiley Face Logo For Their ‘Redux Grunge’ Collection

High end clothier Marc Jacobs is being accused of biting after their “Heaven collection included an animated face that is exactly like that of rock legends Nirvana.

Last December, the fashion designer was sued by lawyers representing the band who claimed that his company ripped off the design.

A squiggly yellow smiley face illustration first appeared on a flyer for a release party for the ‘Nevermind’ album in 1991. The design was later trademarked by the band in 1992.

Jacobs has now filed a response demanding the lawsuit be dismissed, according to Pitchfork Magazine.

He claims that the smiley face design featured on a t-shirt, sweatshirt, and pair of socks in his Redux Grunge Collection, released in November, does not infringe on the band’s own iconic (and copyrighted) smiley logo.

Jacobs’ lawyers argue that Nirvana, L.L.C. is not the legitimate owner of the “Happy Face” logo copyright registration, that the registration is invalid, and that the fashion brand did not copy copyrightable aspects of the logo.

The filing also claims that the smiley logo featured on items in his collection bears a similar squiggly mouth and stuck-out tongue as the Nirvana smiley, but swaps in the letters M and J for eyes, and includes the word “Heavenly” in a serif font that slightly differs from the band’s logo, adding: “Marc Jacobs reinterpreted the design.” A table for comparison was also filed, which you can view above.

Cobain’s daughter, Frances Bean Cobain, previously fronted a campaign for Jacobs’ Spring collection in 2017.
